Budget Highlights

The Division of Alcoholic Beverage Control (ABC) regulates and controls the manufacture, sale and distribution of alcoholic beverages within the State. The Division also issues and renews licenses and permits to manufacturers, distributors, wholesalers and retailers and works with local law enforcement agencies to ensure compliance with the ABC law.

This Agency is included in the Public Protection and General Government appropriation bill.

State Operations

The Executive's proposed budget for State Fiscal Year (SFY) 2004-05 includes Special Revenue Fund-Other appropriations of $13,502,000 reflecting an increase of $204,500 or 1.5 percent from SFY 2003-04. This increase represents:

a $566,000 net increase in appropriation reflecting costs associated with continuing current programs, including salary adjustments and other fixed costs as follows:

a $20,000 reduction in personal service costs, a $407,000 increase in fringe benefit costs, a $105,000 increase in fixed costs, $99,000 increase associated with the Division’s anticipated move to the Alfred E. Smith building, and a $25,000 decrease achieved by transfer of certain administrative functions, such as payroll, to the Office of General Services;

a $225,000 decrease resulting from the elimination of the State Liquor Authority (SLA), and retention of two Commissioners on a per-diem basis for disciplinary hearings; and

a $136,000 decrease achieved by closing the Division's Syracuse office.

The Executive’s SFY 2004-05 budget recommendation for the Division assumes a workforce of 153 Full-Time Equivalent (FTE) positions, reflecting a decrease of 6 FTE positions from the current level.

Article VII

The Executive proposes legislation to abolish the State Liquor Authority and transfer its functions to the ABC.

The Executive also proposes legislation to authorize the ABC to increase most new filing fees for alcoholic beverage licenses and permits to reflect State administrative costs.

The Executive proposes legislation to allow for the direct shipment of wine into New York State from out of state wineries, after receiving a license and with the payment of appropriate taxes.
