Relates to amending the education law, in relation to requiring
completion of a training program on the treatment of those with intel-
lectual and developmental disabilities and chronic illness for certain
medical professionals.

JUSTIFICATION:
There is a growing population of individuals who are living with intel-
lectual and/or developmental disabilities and with chronic illness. Many
of these individuals are compelled to remain with or return to their
pediatric medical provider because the adult medical professionals are
not trained in treating these individuals with their specific disabili-
ties. This was not a required part of training or continuing education.
This training would ensure that all medical providers are trained in
dealing with this population.

This act shall take effect one year after it shall have become a law.
Effective immediately, the addition, amendment and/or repeal of any rule
or regulation necessary for the implementation of this act on its effec-

AN ACT to amend the education law, in relation to requiring completion

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 6524-a
2 to read as follows:
3 § 6524-a. Mandatory training on the treatment of those with intellec-
4 tual and developmental disabilities and chronic illness. 1. All physi-
5 cians, in order to maintain his or her license in good standing, shall
6 complete a biennial training program on the treatment of those with
7 intellectual and developmental disabilities and chronic illness.
8 2. Such training program shall be developed and administered by the
9 department in conjunction with the department of health.
10 3. Such training program shall include, but not be limited to, the
11 following:
12 a. didactic classroom instruction, experiential learning, and online
13 learning, totaling not less than six hours; and
14 b. best practices for the treatment and care for patients who are
15 individuals with intellectual and developmental disabilities and chronic
16 illness, including but not limited to autism spectrum disorders.
17 4. The department in conjunction with the department of health shall
18 periodically evaluate such training program for relevance and practical-
19 ity.
20 5. The department shall prepare, publish and disseminate a list of
21 available training programs pursuant to this section; provided, however,
22 that the list shall be updated annually. The list shall be published in

4 physicians licensed under this article shall complete six hours of
5 training biennially.

41 2. Such training program shall be developed and administered by the
42 department in conjunction with the department of health.
43 3. Such training program shall include, but not be limited to, the
44 following:
45 a. didactic classroom instruction, experiential learning, and online
46 learning, totaling not less than six hours; and
47 b. best practices for the treatment and care for patients who are
48 individuals with intellectual and developmental disabilities and chronic
49 illness, including but not limited to autism spectrum disorders.
50 4. The department in conjunction with the department of health shall
51 periodically evaluate such training program for relevance and practical-
52 ity.

43 3. Such training program shall include, but not be limited to, the
44 following:
45 a. didactic classroom instruction, experiential learning, and online
46 learning, totaling not less than six hours; and
47 b. best practices for the treatment and care for patients who are
48 individuals with intellectual and developmental disabilities and chronic
49 illness, including but not limited to autism spectrum disorders.

38 license or certificate in good standing, shall complete a biennial
39 training program on the treatment of those with intellectual and devel-
40 opmental disabilities and chronic illness.
41 2. Such training program shall be developed and administered by the
42 department in conjunction with the department of health.
43 3. Such training program shall include, but not be limited to, the
44 following:
45 a. didactic classroom instruction, experiential learning, and online
46 learning, totaling not less than six hours; and
47 b. best practices for the treatment and care for patients who are
48 individuals with intellectual and developmental disabilities and chronic
49 illness, including but not limited to autism spectrum disorders.
50 4. The department in conjunction with the department of health shall
51 periodically evaluate such training program for relevance and practical-
52 ity.

14 2. Such training program shall be developed and administered by the
15 department in conjunction with the department of health.
16 3. Such training program shall include, but not be limited to, the
17 following:
18 a. didactic classroom instruction, experiential learning, and online
19 learning, totaling not less than six hours; and
20 b. best practices for the treatment and care for patients who are
21 individuals with intellectual and developmental disabilities and chronic
22 illness, including but not limited to autism spectrum disorders.

43 3. Such training program shall include, but not be limited to, the
44 following:
45 a. didactic classroom instruction, experiential learning, and online
46 learning, totaling not less than six hours; and
47 b. best practices for the treatment and care for patients who are
48 individuals with intellectual and developmental disabilities and chronic
49 illness, including but not limited to autism spectrum disorders.
50 4. The department in conjunction with the department of health shall

14 department in conjunction with the department of health.
15 3. Such training program shall include, but not be limited to, the
16 following:
17 a. didactic classroom instruction, experiential learning, and online
18 learning, totaling not less than six hours; and
19 b. best practices for the treatment and care for patients who are
20 individuals with intellectual and developmental disabilities and chronic
21 illness, including but not limited to autism spectrum disorders.

40 opmental disabilities and chronic illness.
41 2. Such training program shall be developed and administered by the
42 department in conjunction with the department of health.
43 3. Such training program shall include, but not be limited to, the
44 following:
45 a. didactic classroom instruction, experiential learning, and online
46 learning, totaling not less than six hours; and
47 b. best practices for the treatment and care for patients who are
48 individuals with intellectual and developmental disabilities and chronic
49 illness, including but not limited to autism spectrum disorders.
50 4. The department in conjunction with the department of health shall
51 periodically evaluate such training program for relevance and practical-
52 ity.

12 tain his or her license in good standing, shall complete a biennial
13 training program on the treatment of those with intellectual and devel-
14 opmental disabilities and chronic illness.
15 2. Such training program shall be developed and administered by the
16 department in conjunction with the department of health.
17 3. Such training program shall include, but not be limited to, the
18 following:
19 a. didactic classroom instruction, experiential learning, and online
20 learning, totaling not less than six hours; and
21 b. best practices for the treatment and care for patients who are
22 individuals with intellectual and developmental disabilities and chronic
23 illness, including but not limited to autism spectrum disorders.
24 4. The department in conjunction with the department of health shall

42 chronic illness.
43 2. Such training program shall be developed and administered by the
44 department in conjunction with the department of health.
45 3. Such training program shall include, but not be limited to, the
46 following:
47 a. didactic classroom instruction, experiential learning, and online
48 learning, totaling not less than six hours; and
49 b. best practices for the treatment and care for patients who are
50 individuals with intellectual and developmental disabilities and chronic
51 illness, including but not limited to autism spectrum disorders.

11 language pathologists and audiologists, in order to maintain his or her
12 license in good standing, shall complete a biennial training program on
13 the treatment of those with intellectual and developmental disabilities
14 and chronic illness.
15 2. Such training program shall be developed and administered by the
16 department in conjunction with the department of health.
17 3. Such training program shall include, but not be limited to, the
18 following:
19 a. didactic classroom instruction, experiential learning, and online
20 learning, totaling not less than six hours; and
21 b. best practices for the treatment and care for patients who are
22 individuals with intellectual and developmental disabilities and chronic
23 illness, including but not limited to autism spectrum disorders.
24 4. The department in conjunction with the department of health shall
25 periodically evaluate such training program for relevance and practical-
26 ity.

39 counselors, marriage and family therapists, psychoanalysts, and creative
40 arts therapists, in order to maintain his or her license in good stand-
41 ing, shall complete a biennial training program on the treatment of
42 those with intellectual and developmental disabilities and chronic
43 illness.
44 2. Such training program shall be developed and administered by the
45 department in conjunction with the department of health.
46 3. Such training program shall include, but not be limited to, the
47 following:
48 a. didactic classroom instruction, experiential learning, and online
49 learning, totaling not less than six hours; and
50 b. best practices for the treatment and care for patients who are
51 individuals with intellectual and developmental disabilities and chronic
52 illness, including but not limited to autism spectrum disorders.

9 complete six hours of training biennially.
10 § 18. The education law is amended by adding a new section 8504-b to
11 read as follows:
12 § 8504-b. Mandatory training on the treatment of those with intellec-
13 tual and developmental disabilities and chronic illness. 1. All respir-
14 atory therapists and respiratory therapy technicians, in order to main-
15 tain his or her license in good standing, shall complete a biennial
16 training program on the treatment of those with intellectual and devel-
17 opmental disabilities and chronic illness.
18 2. Such training program shall be developed and administered by the
19 department in conjunction with the department of health.
20 3. Such training program shall include, but not be limited to, the
21 following:
22 a. didactic classroom instruction, experiential learning, and online
23 learning, totaling not less than six hours; and
24 b. best practices for the treatment and care for patients who are
25 individuals with intellectual and developmental disabilities and chronic
26 illness, including but not limited to autism spectrum disorders.
27 4. The department in conjunction with the department of health shall
28 periodically evaluate such training program for relevance and practical-
29 ity.
30 5. The department shall prepare, publish and disseminate a list of
31 available training programs pursuant to this section; provided, however,
32 that the list shall be updated annually. The list shall be published in
33 a location that is accessible to persons required to attend such train-
34 ing program.
35 6. Beginning one year after the effective date of this section, all
36 respiratory therapists and respiratory therapy technicians licensed
37 under this article shall complete six hours of training biennially.
38 § 19. The education law is amended by adding a new section 8804-a to
39 read as follows:
40 § 8804-a. Mandatory training on the treatment of those with intellec-
41 tual and developmental disabilities and chronic illness. 1. All licensed
42 behavior analysts or certified behavior analyst assistants, in order to
43 maintain his or her license or certification in good standing, shall
44 complete a biennial training program on the treatment of those with
45 intellectual and developmental disabilities and chronic illness.
46 2. Such training program shall be developed and administered by the
47 department in conjunction with the department of health.
48 3. Such training program shall include, but not be limited to, the
49 following:
50 a. didactic classroom instruction, experiential learning, and online

52 b. best practices for the treatment and care for patients who are

13 § 20. This act shall take effect one year after it shall have become a
14 law. Effective immediately, the addition, amendment and/or repeal of any
15 rule or regulation necessary for the implementation of this act on its
16 effective date are authorized to be made and completed on or before such
17 effective date.
