Assemblywoman Donna Lupardo (D-Endwell) is urging the Governor to sign legislation she sponsored to improve traffic safety and to reduce yield right-of-way violations which result in vehicle crashes involving motorcyclists, pedestrians, and bicyclists. This has become especially relevant given the recent crashes involving drivers failing to yield the right of way causing one fatal and one serious motorcycle accident.

Under the legislation (A.4914/S.3410), penalties for yield right-of-way accidents resulting in serious injury or the death would be increased to include the suspension or revocation of a driver’s license. In addition, courts would be authorized to require participation in a motor vehicle accident prevention course.

“These types of crashes have increased significantly over the last several years, causing serious injury and death,” said Lupardo. “Awareness is critical to crash prevention and traffic safety. I am urging motorists to be on the look-out for motorcyclists, bicyclists, and pedestrians.”

Lupardo was joined by members of American Bikers Aimed Toward Education (ABATE- Southern Tier Chapter) on Wednesday, July 19, 2006, for a news conference to discuss the legislation and call for public awareness. ABATE of New York is an organization dedicated to promoting motorcycle safety, awareness and education.

The legislation is expected to be considered by the Governor this summer. Should the bill become law, it would go into effect November 1, 2006.

Lupardo was recently selected by ABATE as their “Legislator of the Year.” She is a member of the Transportation Committee in the Assembly.
