Press Statement on Reducing E-Bike Food Delivery Crashes/Requiring No Fault Insurance to Protect Drivers, Pedestrians and Cyclists

Albany, NY Assemblymember Robert Carroll (D/WF-Brooklyn) issued the following statement calling on food delivery apps to carry no fault insurance to incentivize safe food delivery practices in response to the tragic death of Luis Cruz, who was struck by an e-bike food delivery worker in Greenpoint, Brooklyn Friday night.

“I was deeply disturbed to hear of the tragic death of Luis Cruz, who was struck by an e-bike food delivery worker in Greenpoint, Brooklyn Friday night. It is past time for companies like Grub Hub, Door Dash, and Uber Eats to take greater responsibility for ensuring that the food delivery drivers working for them drive safely for the protection of all including the drivers themselves. My bill A.70/S.1162 requires the delivery app companies to maintain no fault insurance coverage for people providing food deliveries on their behalf modeled on the State's requirements for insurance for cars and other vehicles. This legislation places the onus of responsibility on the online tech companies, who are profiting from the food delivery culture, and will incentivize them to prioritize safety for workers and pedestrians rather than deliveries being provided at unsafe speeds; it will provide for a modicum of relief to those involved in crashes and will mean that the delivery companies will need to put in place meaningful safety protocols or face increasing insurance premiums. While e-bike crashes make-up a small percentage of vehicle crashes overall, one of the most frequent calls to my office is from pedestrians, especially seniors and parents with small children, concerned about speeding food delivery drivers not following traffic laws."
