Disposition of Forfeited Funds and Property |

PURPOSE: |
To examine the allocation and expenditure of funds forfeited under criminal and civil forfeiture laws in New York State and the use and disposition of property forfeited under such laws, and to examine the impact that such forfeited funds and forfeited property may have on the State Fiscal Year (SFY) 2005-06 Budget. |

New York State law requires collection and dissemination of an array of data related to forfeited funds and property (see CPLR §1311(11) and Executive Law §837-a (6), respectively). On the scheduled hearing date, the Assembly Codes Committee will seek information on the circumstances by which forfeited monies and property come into the possession of law enforcement entities, and the extent to which proceeds or instrumentalities from crimes are ultimately utilized for the furtherance of law enforcement goals and activities. The Committee intends to explore measures taken to enhance accountability over forfeited funds and property from time of seizure to disposition of the seized monies and property. This hearing shall be held in accordance with Rule IV, section 4(b) of the Rules of the Assembly. Persons wishing to present pertinent testimony to the Committee at the above hearing should complete and return the enclosed reply form as soon as possible. It is important that the reply form be fully completed and returned so that persons may be notified in the event of emergency postponement or cancellation. Thirty copies of any prepared testimony should be submitted at the hearing registration desk. The Committee would appreciate advance receipt of prepared statements. In order to further publicize these hearings, please inform interested parties and organizations of the Committee's interest in hearing testimony from all sources. In order to meet the needs of those who may have a disability, the Assembly, in accordance with its policy of non-discrimination on the basis of disability, as well as the 1990 Americans with Disabilities Act (ADA), has made its facilities and services available to all individuals with disabilities.
