Assemblyman Colton Supports the CDPAP Program

Assemblyman Colton (D – Gravesend, Bensonhurst, Bath Beach, and Dyker Heights) Co-Sponsors Assembly bill A-06479 sponsored by Assembly Member Gottfried which supports the CDPAP program. Earlier this year the New York State Department of Health announced that approximately 80% of the State’s Personal Assistance Plan (CDPAP) will be forced to seek new providers. Assembly bill A-06479 is to allow fiscal intermediary (FI) services to continue to be provided by FIs whose eligible providers were as of January 1, 2020, until April 1, 2022. The Commissioner of Health will issue a new request for applications for contracts for services after the extension expires, with more specific requirements applied to the scoring of applications.

“The Consumer Directed Personal Assistance Program (CDPAP) is a New York State Medicaid program that permits consumers to hire their own home care workers. This program provides services to chronically ill or physically disabled individuals who have a medical need for help with activities of daily living. I believe that the most important part of the program is that it allows clients to appoint family members and friends’ individuals that they trust and are comfortable with,” Colton stated.

“I am aware of the lawsuit that was filed by CDPAANYS and individual Fiscal Intermediaries, where they are claiming that the rate cuts violated both federal and state requirements and that they are so severe that it will put many CDPAP fiscal intermediaries out of business. We can’t just eliminate this program which is essential for many chronically ill and physically disabled individuals. I think that there are many important factors such as individuals may have a language barrier or be left without adequate home care due to changes and so on. I support the CDPAP program and will continue to support it.,” Colton added.
